课程报名须知与服务条款  Terms & Conditions for Course Registration

为维护您的权益，报名缴费前请务必详阅以下条款。完成报名程序后，即视为您已充分理解并同意受下列规范约束。本条款以中、英文双语撰写。若中文版与英文版之间存在任何歧义或冲突，应以英文版为准。

To safeguard your rights, please read the following terms and conditions carefully before registering and making payment. Upon completing the registration process, you are deemed to have fully understood and agreed to be bound by these regulations. These terms are executed in both Chinese and English. In the event of any discrepancy or conflict between the Chinese and English versions, the English version shall prevail.

I.报名与开班规范 Course Registration & Class Commencements

1.资讯确认 Information Verification：

报名时请务必确认课程之开课日期、上课时间、教学型态（实体或线上）及地点。

Upon registration, participants must verify all course details, including the commencement date, time, learning mode (physical or online), and venue.

2.开班调整 Class Adjustments：

各类班次若未达规定之最低开班人数，本公司有权停开或延后开课。如遇特殊状况须延期或停止开课时，将以社群讯息、电话或电子邮件联系办理。

The Company reserves the right to cancel or postpone any class that fails to meet the minimum required number of participants. In the event of rescheduling or cancellation, affected participants will be notified via social messaging, telephone, or email.

3.师资变更 Changes to Faculty：

如遇特殊情形，本公司保有调整师资、课程内容或上课教室/线上平台之权利。

Under exceptional circumstances, the Company reserves the right to substitute instructors, amend course content, or change the physical classroom or online platform.

4.参与资格 Eligibility：

课程仅限报名学员本人参与，恕不提供旁听，亦不可携伴陪同。

Admission is strictly restricted to the registered participant. No sit-ins or accompanying guests are permitted.

5.优惠方案 Promotional Schemes：

方案经选定缴费后不得变更；若因个人操作导致溢缴，溢缴费用转为「课程折价券」（自核发日起一年内有效）供下次使用，恕不退现。

Promotional packages cannot be altered once payment is finalized. Any overpayment resulting from user error will be converted into a "Course Voucher" (valid for one year from the date of issuance) for future use and is non-refundable in cash.

II.换课、转让与补课规定 Course Deferment, Transfer & Makeup Policy

1.换课申请 Course Deferment or Change：

每位学员、每张报名表仅限申请一次换课，且须于开课日前7日以前提出。办理时学员需签署『换课同意书』并同意放弃退费权利。高出之差额需补足，若更换课程价值较低，差额将转为「课程折价券」（一年有效），恕不退现。

Each participant is entitled to one (1) course change per registration, provided the request is submitted at least seven (7) days prior to the course commencement. Participants must sign a "Course Change Agreement" and waive their right to any refund. Any shortfall in fees must be topped up; if the new course is of lower value, the balance will be issued as a "Course Voucher" (valid for one year) and is non-refundable in cash.

2.转让申请 Course Transfer：

若无法出席，可于开课日1日以前的办公时间（平日周一至周五9:00-18:00，不含马来西亚国定假日与雪兰莪州公共假期）通知本公司办理无偿转让。办理时，学员及受让人需共同签署『转让同意书』，受让人亦须完全同意并遵守本服务条款之所有规范，且双方同意放弃退费权利。

If a participant is unable to attend, the slot may be transferred to another person free of charge, provided notification is given at least one (1) day prior to commencement during official working hours (Monday to Friday, 9:00 AM – 6:00 PM; excluding Malaysian Public Holidays and Selangor State Holidays). Both the original participant and the transferee must sign a "Course Transfer Agreement." The transferee must fully agree to and comply with all terms and conditions herein, and both parties waive all rights to a refund.

3.退补限制 Restrictions：

经办理过「换课」及「转让」之名额，后续不得再申请退费。因个人因素（如迟到、缺席、操作不当）无法上课或插班加入者，本公司不提供补课、调课或减免学费之服务。

Slots that have undergone a "Change" or "Transfer" are strictly non-refundable. The Company does not provide makeup classes, slot adjustments, or tuition fee reductions for absences, tardiness, or failure to log in due to personal reasons.

III.退费规定 Refund Policy

依据马来西亚《1999年消费者保护法令》之不公平合约条款原则与本公司规范制定。

Formulated in accordance with the principles of Unfair Contract Terms under the Malaysian Consumer Protection Act 1999 and corporate regulations.

1.法人/企业/团体客户 Corporate or Group Clients

企业包班或团体报名，退费规定悉依双方签署之正式合约为准。若无额外签署合约，则开课日前30日以内恕无法办理退费；开课日前30日以前办理，则依个人学员规定办理。

Refund policies for corporate customized training or group registrations shall be governed by the formal contract executed by both parties. In the absence of a separate contract, no refunds shall be granted within thirty (30) days prior to the course commencement; requests made more than thirty (30) days prior shall follow the Individual Participant policy.

2.个人学员 Individual Participants

因个人因素申请退费者，需签署『退费同意书』，并依以下收到的申请时间戳记（不含开课当日），采阶梯式比例办理：

Refund requests due to personal reasons require the execution of a "Refund Request Form." Refunds will be processed on a graduated scale based on the official timestamp of receipt (excluding the day of commencement)：

• 开课7日以前 7 days or more prior：退还 Refund 90%（扣除10%行政費 10% Administration Fee retained）

• 开课3至6日以前 3 to 6 days prior：退还 Refund 70%（包含席次保留成本，如場地、平台及講師費用 Retained for seat reservation costs, including venue, platform, and instructor fees）

• 开课1至2日以前 1 to 2 days prior：退还 Refund 50%（包含席次保留成本，如場地、平台及講師費用 Retained for seat reservation costs, including venue, platform, and instructor fees）

• 开课当日及开课后 On or after commencement：退还 Refund 0%（視同放棄退費權利 Deemed as forfeiture of refund rights）

3.教材与手续费特别说明 Special Notes on Materials and Transaction Fees

退费比例以学员实付总金额计算。

The refund percentage shall be calculated based on the actual net amount paid by the participant.

• 教材处理 Course Materials & Kits：

学员若已领取实体教材或教具（含寄送到府），退回之运费由学员负担。退回时须确保全新未拆封。若教材之封膜、封条、包装经拆封，或内容物有书写、折损、污损、毁损等使用痕迹，即视同已使用，本公司将于退款中扣除该教具之原价成本。

If physical materials or kits have been received (including home delivery), the participant shall bear the return shipping costs. Returned items must be brand new and unopened. If the shrink-wrap, seal, or packaging is broken, or if the contents show signs of writing, folding, staining, or damage, the materials will be deemed used, and the cost of the materials will be deducted from the refund amount.

• 第三方平台 Third-Party Platforms：

若透过第三方平台（如：经销/代理商、票务平台）报名，其退票规则与手续费依该平台之规定办理。

For registrations made via third-party channels (e.g., distributors, agents, ticketing platforms), the refund rules and service fees of the respective platform shall apply.

• 转账费用 Bank Charges：

退款产生之银行转账手续费由学员负担，将于退款中径行扣除。

Any bank transfer fees or transaction charges incurred during the refund process shall be borne by the participant and deducted directly from the final refund amount.

IV.智慧财产权与录音录影限制Intellectual Property & Recording Restrictions（含线上与实体 including online and physical）

1.版权归属 Ownership of Copyright：

课程发放之讲义、教具、线上影音、直播内容及所有教学素材，版权归本公司所有。仅供学员本人学习使用，严禁翻印、转售、重制、公开散布或进行任何商业教学行为。如有违反，本公司保留依马来西亚《1987年版权法令》及相关法律追诉之权利。

All hand-outs, teaching kits, online audio/visual materials, live streams, and educational resources provided are the intellectual property of the Company. They are strictly for the participant's personal learning use. Any reproduction, resale, redistribution, broadcasting, or commercial teaching utilization is strictly prohibited. The Company reserves all rights to pursue legal action under the Malaysian Copyright Act 1987.

2.严禁非法侧录 Prohibition of Unauthorized Recording：

不论实体课程或线上课程（直播与录播），全体学员严禁进行任何形式之录音、录影、萤幕截图、侧录或使用软体下载课程内容（除讲师指定之实作纪录时间外）。

Regardless of physical or online learning modes (both live and recorded), all participants are strictly prohibited from audio recording, video recording, taking screenshots, screen-recording, or using software to download course contents (except during practical sessions explicitly designated by the instructor).

3.散布罚则 Penalties for Distribution：

未经本公司书面授权之侧录或教学内容，若经外流、上传至公开网路平台、社群媒体或作为任何商业与非商业用途，本公司将依马来西亚《1987年版权法令》移送相关执法机关，并追究民刑事法律责任。

Any unauthorized recording or leaked content distributed, uploaded to public online platforms, shared on social media, or used for commercial or non-commercial purposes will be referred to the relevant law enforcement agencies under the Malaysian Copyright Act 1987, and the participant shall be held liable for civil and criminal damages.

V.线上课程特别特定规范 Specific Regulations for Online Courses（实体不适用 physical ones do not apply）

1.设备自我负责 Hardware and Connectivity Responsibility：

学员应于报名前自行确认具备参与线上课程之必要设备与稳定网路。课程开始后，若因学员端个人设备、网速或作业系统不相容导致无法连线或影音品质不良，学员应自行承担。

Participants must ensure they possess the necessary hardware (computer, smartphone, tablet, web camera, microphone, etc.) and stable internet connectivity prior to registration. The Company shall not be held liable, nor accept refund requests, for disconnection or poor audio/video quality arising from participant-end device errors, internet speed, or operating system incompatibilities.

2.单一装置与帐号限制 Single Device & Account Restrictions：

本公司提供之课程登入连结、会议 ID、密码或平台帐号，仅限报名学员本人单一装置使用，严禁分享予任何第三人。经系统侦测或查证有同一帐号多处登入或非本人使用之情事，本公司有权立即终止该观看权限，其已缴学费将转为违约惩罚金且不予退还，并保留法律追诉权。

Access links, meeting IDs, passwords, or platform accounts provided by the Company are restricted strictly to one (1) single device per registered participant and must not be shared. Upon detection or verification of simultaneous multi-device logins or unauthorized usage, the Company reserves the right to immediately terminate the access, and all fees paid shall be forfeited as liquidated damages / penal sums, with legal rights reserved.

VI.课堂秩序、肖像权与个人资料保护 Classroom Decorum, Consent & Data Protection

1.秩序与法律维护 Decorum & Legal Compliance：

• 实体 Physical Classes：

学员于实作期间应遵从讲师指导，若因违反指示或人为疏失导致自身受伤或现场设备毁损，需依原价负担赔偿责任，本公司不负赔偿责任。

Participants must follow the instructor's guidance during practical sessions. The Company shall not be held liable for any injury or property damage resulting from a participant's failure to adhere to instructions or negligence; the participant shall bear full restoration or compensation costs.

• 线上 Online Classes：

讲师有权要求学员于特定互动时段开启视讯镜头。学员于线上聊天室发言应遵守网路礼仪，严禁发表涉及人身攻击、骚扰、歧视、商业广告或违反马来西亚法律（包括但不限于《1998年通讯及多媒体法令》中有关有害内容之规定）之言论。

Instructors reserve the right to request participants to turn on their video cameras during interactive periods. Participants must maintain online etiquette in the chatrooms. Any remarks involving personal attacks, harassment, discrimination, commercial advertisements, or violations of Malaysian laws (including but not limited to prohibited content under the Communications and Multimedia Act 1998) are strictly forbidden.

• 惩罚 Penalties：

违反上述实体或线上秩序规范者，本公司有权强制请离现场或移出线上教室，其已缴学费将转为违约惩罚金且不予退还。

Any participant who violates physical or online decorum will be removed from the premises or online classroom immediately, and all fees paid shall be forfeited as liquidated damages / penal sums.

2.肖像授权 Photography & Videography Consent：

课程期间本公司将进行摄影或录影，作为成果纪录及行销推广（如：官网、社群媒体等）使用。报名即视同授权本公司使用包含学员肖像之影音素材。若有特殊隐私需求，请于课前主动告知工作人员。

Photography and videography will be conducted during classes for documentation, archival, and promotional purposes (e.g., official website, social media). Registration constitutes consent for the Company to utilize visual assets containing the participant's likeness. Participants with specific privacy concerns must inform the staff prior to the commencement of the class.

3.个资保护 Personal Data Protection：

您提供的个人资料仅用于课程联系、保险投保（若有）及本公司后续课程资讯发送。本公司将依据马来西亚《2010年个人资料保护法令》（PDPA）严格保护及处理您的个人资料。

All personal data provided will be processed strictly for course communication, insurance enrollment (where applicable), and subsequent marketing communications by the Company. Your data will be strictly managed and protected in compliance with the Malaysian Personal Data Protection Act 2010 (PDPA).

VII.不可抗力与特殊状况 Force Majeure & Special Circumstances

1.全额退费基准 Full Refund Criteria：

如遇不可抗力事件（如天灾、水灾、疫病等），并经马来西亚政府或相关地方当局公告暂停营运、停课，或因本公司因素（如未达开班人数、讲师急病），本公司将主动办理延期或全额退费（含转账手续费由本公司负担）。

In the event of Force Majeure (including but not limited to natural disasters, floods, epidemics) resulting in operational suspension or closure orders issued by the Malaysian Government or local authorities, or due to Company-end factors (e.g., failure to meet minimum enrollment, sudden illness of the instructor), the Company will arrange a course deferment or issue a full refund (bank transfer fees will be borne by the Company).

2.退费作业时间 Processing Time：

相关退费手续将于 7～10 个工作天内完成汇款。

Refund payouts will be processed and credited via bank transfer within seven (7) to ten (10) working days.

【声明与同意 Declaration and Consent】

本人已详阅并同意「健心菀文教网报名须知与服务条款」（包含换课/退费规定、智慧财产权、线上课程规范、肖像权授权及个人资料保护声明）。完成报名缴费后，即代表本人完全接受上述内容之约束。

I have read, understood, and agreed to the "Terms & Conditions for Course Registration" of Jian Xin Wan Education Network (including deferment/refund rules, intellectual property rights, online course guidelines, photography consent, and personal data protection statements). Completion of registration and payment constitutes my full acceptance of and agreement to be bound by these terms.
